General Terms and Conditions of Sale

These terms and conditions apply to all sales concluded with the Hôtel des Marquisats (6 chemin de Colmyr, 74000 Annecy), with the exception of group bookings. By making a booking, the client acknowledges having read these general terms and conditions of sale and agrees to comply with them.

These terms and conditions of sale are subject to change at any time; the applicable terms will be those in effect on the date the booking is made.

ARTICLE 1 - RATES

The rates shown are in euros and include all taxes (TTC), reflecting the VAT applicable on the day of booking. Any change in the applicable rate, or any modification or introduction of new statutory taxes by the competent authorities, will be automatically reflected in the prices charged at the time of invoicing.

Rates are per room for the specified number of guests and the selected period; they do not include additional services (unless otherwise stated).

The tourist tax of €1.70 per day per person (aged 18 and over) is not included in the displayed price and must be paid directly on-site. It applies from January 1st to December 31st of each year.

Certain services may incur an additional charge and are subject to change without notice; the hotel accepts no liability in this regard.

No stays booked prior to the introduction of any promotional offer will be eligible for a refund, whether partial or full.

 

ARTICLE 2 - RESERVATIONS AND PAYMENT METHODS

The client acknowledges having read the General Terms and Conditions of Sale provided by Hôtel des Marquisats and having requested and obtained all information necessary to make a reservation with full knowledge of the facts. The client certifies the accuracy of the information provided and confirms that the reservation is made by and for adults.

Reservations may be made via the websites www.hoteldesmarquisats.com and www.marquisats.com, or by telephone, email, or mail.

A reservation becomes effective only once it has been guaranteed by the client—either by providing a credit card number valid for the scheduled dates of the stay or by paying a deposit (non-refundable)—and a detailed reservation confirmation has been received.

Payment for all services must be made directly to the hotel via the secure PAYZEN payment system; payment is required no later than 48 hours prior to the arrival date (with the exception of reservations prepaid at the time of booking).

The hotel reserves the right to refuse or cancel any reservation if the credit card number provided is incorrect (or if a pre-authorization on the provided card is declined) or if the reservation is incomplete (or does not comply with the establishment's regulations).

Reservations, regardless of their origin, must be paid for in Euros (€) only.

Hôtel des Marquisats accepts the following credit cards for on-site payment: Visa, Mastercard, and American Express. It utilizes a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted during the booking process to prevent disclosure to third parties.

The client is solely responsible for their choice of services and their suitability for their needs; consequently, Hôtel des Marquisats cannot be held liable in this regard.

ARTICLE 3 - MODIFICATION AND CANCELLATION OF STAY

Any modification or cancellation of a reservation must be requested via email at reservations@marquisats.com or by phone at 04 50 51 52 34.

The request becomes effective only once Hôtel des Marquisats has confirmed its acceptance in writing.

If you booked through an intermediary (online travel agencies, online comparison sites, online booking platforms, etc.), you must continue dealing with the party used for the original booking and contact those same intermediaries to manage cancellations.

The date the cancellation notice is received determines the cancellation date.

In the event of a modification or cancellation of the stay, the following conditions apply:

- For any request made outside the specified cancellation window, you will be charged the full amount of the stay.

- In the event of a no-show on the scheduled arrival date without prior cancellation, we will retain the full cost of the stay as compensation, and the reservation will be cancelled. Please note that any deposit paid will not be refunded, or—if no prepayment was made—your credit card will be charged the full amount of the stay.

- Any stay that has commenced must be paid for in full.

For reservations made via our partners' websites, cancellations must be processed exclusively through those sites. The applicable cancellation terms are those of the partner and may therefore differ from the policies of Hôtel des Marquisats.

To extend a stay, the guest must notify the hotel reception no later than 10:00 AM on the scheduled day of departure to check availability.

ARTICLE 4 - THE HOTEL AND SERVICES

The child breakfast rate applies to children under 12 years of age.

For health and safety reasons, pets are not permitted on the premises.

Rooms are available from 3:00 PM and must be vacated by 11:30 AM on the day of departure.

Please note that late check-outs are not accepted; a flat-rate surcharge will be charged—equivalent to the cost of the final night’s stay—for any departure after the specified time (i.e., after 11:30 AM).

For arrivals after 10:00 PM, the reception must be notified in writing before 8:00 PM to confirm the arrangement and receive instructions for self-check-in. Otherwise, if the guest has not arrived by 10:00 PM on the scheduled arrival date, the entire reservation will be cancelled as a "no-show."

The guest agrees to use the room in a responsible and prudent manner. Any behavior contrary to public decency or public order will result in the hotel requiring the guest to leave the premises without compensation or refund of any payment already made. The same applies if the number of occupants exceeds the room's maximum authorized capacity (babies under 2 years of age are not counted, provided the hotel has been notified and has given its approval based on the booked room category).

For package bookings, any unused services included in the package are non-refundable and will not be subject to any price reduction.

The credit card used for the booking and valid identification must be presented upon arrival. A security deposit is required upon arrival to cover any incidental expenses or potential damages; this may be paid by credit card or in cash. Failure to do so may result in the Hôtel des Marquisats refusing you access to your accommodation.

You are required to complete a police registration form upon arrival, in accordance with current regulations.

ARTICLE 5 - RELOCATION

In the event that the Hôtel des Marquisats is unavailable or in cases of *force majeure*, the hotel reserves the right to accommodate the guest—fully or partially—in a hotel of an equivalent or higher category offering similar services. The cost of the transfer shall be borne by the hotelier, who shall not be liable for the payment of any additional compensation.

ARTICLE 6 - COMPLAINTS

Any complaint must be sent to the Hôtel des Marquisats by registered letter with acknowledgment of receipt within 15 days of the departure date of the stay to which the complaint relates. No complaints will be considered after this period.

In the event of a dispute between the professional and the consumer, they shall endeavor to reach an amicable solution.

Failing an amicable agreement, the consumer may refer the matter, free of charge, to the consumer ombudsman relevant to the professional—namely AME CONSO—within one year of the written complaint sent to the professional.

The referral to the consumer ombudsman must be made:

-              either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com;

-              or by mail sent to AME CONSO, 197 Boulevard Saint-Germain - 75007 PARIS.

ARTICLE 7 - DATA PROTECTION

In accordance with Law No. 78-17 (the "Data Protection Act"), customers are informed that their booking involves the computerized processing of personal data. Hôtel des Marquisats provides Wi-Fi internet access. Users agree not to use the IT resources made available to them—in any way—for the reproduction, representation, making available, or communication to the public of works or objects protected by copyright or related rights (such as texts, images, photographs, musical or audiovisual works, software, and video games) without the authorization of the rights holders as defined in Books I and II of the Intellectual Property Code, where such authorization is required.

Hôtel des Marquisats operates a video surveillance system in the building's common areas.

ARTICLE 8 - LIABILITY

The hotel accepts no liability for the theft, loss of, or damage to guests' personal belongings during their stay.

The guest shall be held liable for any damage, deterioration, or acts of vandalism arising from the occupancy of the premises and/or the actions of participants and/or staff under their supervision—whether affecting movable property, décor, or the building itself, and regardless of whether such property belongs to the hotel. Consequently, Hôtel des Marquisats reserves the right to require the guest to leave the establishment—without compensation or a refund for the current stay—and to demand reimbursement for any damages caused by such acts.

 

ARTICLE 9 - GOVERNING LAW

These General Terms and Conditions of Sale are governed by French law, regarding both substantive and procedural matters. Any disputes shall fall under the exclusive jurisdiction of the French courts.
