General Terms and Conditions of Sale

These terms and conditions apply to all sales concluded with Hôtel des Marquisats (6 Chemin de Colmyr, 74000 Annecy), with the exception of group bookings. By making a booking, the client acknowledges having read these general terms and conditions of sale and agrees to abide by them.

These terms and conditions are subject to change at any time; the applicable terms will be those in effect on the date the booking is made.

ARTICLE 1 - RATES

The rates shown are in euros and include all taxes (TTC), reflecting the VAT applicable on the date of booking. Any change in the applicable rate, or the modification or introduction of new statutory taxes by the competent authorities, will be automatically reflected in the prices charged on the invoice date.

Rates are per room for the specified number of occupants and the selected period; they do not include additional services (unless otherwise stated).

The tourist tax of  €1.70 per day per person (aged 18 and over) is not included in the displayed price and must be paid directly on-site. It applies from January 1st to December 31st of each year.

Certain services may incur an additional charge and are subject to change without notice; the hotel accepts no liability in this regard.

No refund—partial or otherwise—will be granted for stays booked prior to the introduction of any promotional offer.

ARTICLE 2 - RESERVATIONS AND PAYMENT METHODS

Reservations can be made via the websites www.hoteldesmarquisats.com and www.marquisats.com, or by telephone, email, or mail.

A reservation becomes effective only once guaranteed by the client—either by providing a credit card number with an expiry date or by paying a deposit—and following receipt of a detailed reservation confirmation.

Payment for all services is to be made directly to the hotel (with the exception of reservations prepaid at the time of booking).

The hotel reserves the right to refuse any reservation if the credit card number provided is incorrect or the reservation details are incomplete.

All reservations, regardless of origin, must be paid for in Euros (€) only.

Hôtel des Marquisats accepts Visa, Mastercard, and American Express credit cards and utilizes a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted during booking to prevent disclosure to third parties.

Upon booking, a credit card authorization check will be performed. This is for verification purposes only and does not constitute an actual charge to the account, except in the case of "non-cancellable/non-refundable" reservations.

The client is solely responsible for their choice of services and their suitability for their needs; consequently, Hôtel des Marquisats cannot be held liable in this regard.

ARTICLE 3 - MODIFICATION AND CANCELLATION OF STAY

Any modification or cancellation of a reservation must be requested via email at reservations@marquisats.com or by phone at 04 50 51 52 34.

The request will only become effective once Hôtel des Marquisats has confirmed its acceptance in writing.

In the event of a modification or cancellation of the stay, the following conditions apply:

- For any request made outside the specified cancellation period, the total cost of the stay will be charged.

- In the event of a no-show on the scheduled arrival date, your credit card will be charged the total cost of the stay.

- Any stay that has commenced is payable in full.

For reservations made via our partners' websites, cancellations must be processed through that specific site. The applicable cancellation terms are those of the partner and may therefore differ from the terms of Hôtel des Marquisats.

To extend a stay, the guest must notify the hotel reception no later than 10:00 AM on the scheduled day of departure to check availability.

 

ARTICLE 4 - THE HOTEL AND SERVICES

The child breakfast rate applies to children under the age of 12.

For health and safety reasons, pets are not permitted on the premises.

Rooms are available from 3:00 PM and must be vacated by 11:30 AM on the day of departure.

Please note that late check-outs are not accepted; a flat-rate surcharge acting as compensation will be charged, equivalent to the cost of the final night’s stay, regardless of the departure time outside the specified hours (i.e., after 11:30 AM).

For arrivals after 10:00 PM, the reception must be notified in writing before 8:00 PM to confirm the arrangement and receive instructions for self-check-in. Failure to do so means the reservation will no longer be guaranteed after 10:00 PM on the scheduled arrival date.

The guest agrees to use the room in a responsible and prudent manner. Any behavior contrary to public decency or public order will result in the hotelier requiring the guest to leave the premises without compensation or refund of any payment already made. The same applies if the number of occupants exceeds the room's maximum authorized capacity (babies under 2 years of age are not counted, provided the hotel has been notified and has given its approval based on the booked room category).

ARTICLE 5 - RELOCATION

In the event that the Hôtel des Marquisats is unavailable or in cases of *force majeure*, the hotel reserves the right to accommodate the guest—fully or partially—in a hotel of an equivalent or higher category offering similar services. The cost of the transfer shall be borne by the hotelier, who shall not be liable for the payment of any additional compensation.

In accordance with Law No. 78-17 (the "Data Protection Act"), guests are informed that their reservation involves the computerized processing of personal data. Please note that this information is not shared with third parties.

Hôtel des Marquisats provides Wi-Fi internet access. The guest/user agrees not to use the IT resources made available to them—in any way—for the reproduction, representation, making available, or communication to the public of works or objects protected by copyright or related rights (such as texts, images, photographs, musical or audiovisual works, software, and video games) without the authorization of the rights holders as defined in Books I and II of the Intellectual Property Code, where such authorization is required.

Hôtel des Marquisats operates a video surveillance system in the building's common areas.

ARTICLE 8 - LIABILITY

The hotel accepts no liability for the theft, loss of, or damage to guests' personal belongings during their stay.

The guest shall be held liable for any damage, deterioration, or acts of vandalism arising from the occupancy of the premises and/or the actions of participants and/or staff under their supervision—whether affecting movable property, décor, or the building itself, and regardless of whether such property belongs to the hotel. Consequently, Hôtel des Marquisats reserves the right to require the guest to leave the establishment—without compensation or a refund for the current stay—and to demand reimbursement for any damages caused by such acts.

 

ARTICLE 9 - GOVERNING LAW

These General Terms and Conditions of Sale are governed by French law, regarding both substantive and procedural matters. Any disputes shall fall under the exclusive jurisdiction of the French courts.
